As the Company cannot control these web sites and external sources, the Company cannot be held responsible for the provision or display of these web sites and external sources, and may not be held liable for the content, advertising, products, services or any other material available on or from these web sites or external sources.

Management of personal data

Information We Collect

Our store collects data to operate effectively and provide you the best experiences with our services. You provide some of this data directly, such as when you create a personal account. We get some of it by recording how you interact with our services by, for example, using technologies like cookies, and receiving error reports or usage data from software running on your device. We also obtain data from third parties (including other companies). For example, we supplement the data we collect by purchasing demographic data from other companies. We also use services from other companies to help us determine a location based on your IP address in order to customize certain services to your location. Our web site uses the data we collect for three basic purposes: to operate our business and provide (including improving and personalizing) the services we offer, to send communications, including promotional communications, and to display advertising. However, to enhance privacy, we have built in technological and procedural safeguards designed to prevent certain data combinations. Sharing Your Information

We share your personal data with your consent or as necessary to complete any transaction or provide any service you have requested or authorized. For example, we share your content with third parties when you tell us to do so. When you provide payment data to make a purchase, we will share payment data with banks and other entities that process payment transactions or provide other financial services, and for fraud prevention and credit risk reduction. In addition, we share personal data among our controlled affiliates and subsidiaries. We also share personal data with vendors or agents working on our behalf for the purposes described in this statement. For example, companies we've hired to provide customer service support or assist in protecting and securing our systems and services may need access to personal data in order to provide those functions. In such cases, these companies must abide by our data privacy and security requirements and are not allowed to use personal data they receive from us for any other purpose. We may also disclose personal data as part of a corporate transaction such as a merger or sale of assets.

Wedding Photography and Video Booking Terms and Conditions

This agreement contains the entire understanding between Dave Spink Photography herby known as (DSP) and the Bride and Groom. It replaces any prior agreements that may have been made.  A signed contract and deposit are not necessary to confirm the stated wedding services from DSP for Photography and or Video

The bride and groom will be requested to complete and sign a booking form with all details of the wedding on booking. You are welcome to pop in for an additional chat closer to the time of the wedding to iron out the remaining details and requests. In any case we will contact you by phone a few days before the wedding to ensure that there have been no last minute changes.

You have the right to cancel your order at any time. Below is our cancellation policy.

Within 24 hours a full refund will be issued minus a 2% process fee, after this the following fees will apply. Less than 3 months notice before the event the full payment will be payable. Less than 6 months notice, 50% of the full payment will be due. More than 6 months notice, no further payment will be required to cancel the reservation, your deposit will be held as liquidated damages. In the event of cancellation, we reserve the rights to release this date to other clients.

Any payment outstanding from the Client will be referred to the Agent’s debt recovery company Redwood Collections whose registered office is at Redwood Collections, Airport House, Purley Way, Croydon, CR0 0XZ and will be subject to a surcharge of 15% plus VAT to cover administration fees and costs incurred. Such surcharge together with all other charges and legal fees incurred will be the responsibility of the Client and will be legally enforceable.

From time to time these terms and conditions may need updating we will notify of any change via our facebook page. We advise that you follow our page and check it regularly for updates and information. You'll have 7 days to inform Dave Spink Photography if you do not agree with any amendments. The bride and groom and DSP consent to cheerfully cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. The bride and groom also agree to give the photographer sufficient warning of key events at the wedding to give the photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at wedding like having their photo taken. In such cases the wedding photographer will use his discretion but cannot be held responsible for a lack of photos of these people

Our shooting style of working and experience are designed to achieve a relaxed day where the focus is on the Bride and Groom not the photographer. Both the bride and groom and DSP therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases were the wedding does not run on time (for example, extreme lateness by the bride arriving to the church) we cannot guarantee to take our normal set of shots although in such circumstances we will do our absolute best to compensate. The Price Lists and packages quoted are for all wedding services starting 12:00 noon or later and finishing no later than 9pm extra time is charge in 1 hour blocks at £150 per team. If your wedding service begins earlier than this, then a small extra charge may be applicable Please contact us to discuss.

PAPARAZZI WEDDING GUESTS: All your guests will have digital cameras and all your guests will want to photograph the bride and groom. In the spirit of cheerful cooperation the bride and groom agree to give the photographer precedence over your guests in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if the photographers work has been continually interrupted by guests or other suppliers taking their own photos of the bride and groom

HOUSE RULES: Note the photographer is sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the photographer shoot from a specific location. In such circumstances the bride and groom agree to accept the technical limitations that may be imposed on the equipment used. We advise the bride and groom to make themselves aware of the rules of the venue concerned and if necessary negotiate with the indiums concerned.  Please ensure you have ALL relevant permissions from your venues for the use of photography and Video 

COPYRIGHT LAW: English Copyright Law states that the copyright of photographs remains with the photographer. Copyright ownership of your wedding photos is transferred to the bride and Groom upon full payment under the following conditions. The digital images taken by DSP are for personal use by the bride and groom and their friends and relatives. If selling the wedding photos for profit the bride and groom, their friends and relatives must obtain permission from  Dave Spink.  No Dave Spink Photography production may be broadcast on television / online or in a public place without prior permission.

MODEL RELEASE. The Bride and Groom grant DSP and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the bride and groom for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Bride and groom hereby releases DSP and its legal representatives, heirs and assigns from all liability and claims in connection with the images.  We cannot film Live performances (singing or musical) with audio unless we have FULL written consent from the performers.  Any live music played during a Church ceremony must have the consent from the church and/or artists / performers for use during the entrance and exit of the bridal party.  No hymms will be recorded.  Please ensure if you have a wedding band and they are performing your first dance that we're made aware before the wedding day and that the band give consent to be recorded.  You remain liable for all fees directly or indirectly for use of this music.  We accept no responsibility for costs you may incur.

LIMIT OF LIABILITY: If the photographer/s are too ill or becomes injured and cannot attend wedding services specified above, DSP will do everything possible to book a replacement wedding photographer. Under normal circumstances a second photographer from  DSP is on standby for the day.  From time to time to cover holidays other staff members may attend. If a replacement photographer cannot be found in these circumstances, liability is limited to a refund of any payments received. DSP have working methods in place to prevent the loss or damage to your images however, there exists the unlikely possibility that images may be lost, stolen or destroyed for reasons beyond the control of DSP. In these circumstance liability is limited to the return of fees paid for the service or part thereof according to the percentage of original images supplied.  Any Damage to Dave Spink Photography property and or equipment is to be covered by the Bride and/or Groom.  This is not limited to damage solely by the bridal party but includes any guests, public or staff at the wedding, without exception.  From time to time these terms and conditions may need updating. We'll notify you of any changes and send confirmation to the email address you provided on booking.  Please ensure that you provide the best address as primary contact and that you save our email addresses as contacts to ensure they are not blocked and or deleted by spam robots.  You'll have 7 days to inform Dave Spink Photography if you do not agree with any amendments.  After 7 days have passed you'll be legally bound by the changes.

Our videos include up to 40 minutes from your ceremony and 1 hour from speeches, this covers 99% of weddings.  If you feel you need longer due to your plans please ask the team before booking.  Due to copyright we do not record your hymns, if this is something you'd like to add please provide a copy of your music license and signed permission from the church that they are happy for this to be included.  We provide 2 cameras and two DSP staff members and will personalise your day with your chosen music, stored on USB.

Although by paying a deposit and filling out this booking form, Dave Spink Photography are not accountable for any unforeseen problems that may occur on the way to the Venues or during video filming, (Inc bad weather/ traffic problems etc.) We regularly check all equipment and, if possible, carry spare equipment, but we shall not whatsoever, be liable for any unforeseen losses, omissions or problems, that occur during filming or in post-production and will only be liable for, at the owners discretion, to reducing the original cost or a refund in extreme circumstances.

Final Payment:  The balance of your package is due no later than 1 month before the wedding, payment plans can be arranged and payments can be made in advance though our online payment system.  Late payments will invalidate any special offers or discounts applied on booking.  We reserve the right to cancel any booking with the full amount due immediately if payment is not received.  We can only accept payments through this online booking system.  Cheques and Cash are not accepted.

Dave Spink Photography will produce and store a master copy of your finished product for 6 months. Dave Spink Photography are not accountable for any damage to any master copies, and store them as a courtesy; we would like to note that we do not charge for master tape stock.   We highly recommend that you create a backup of all your images and / or footage on delivery. 

Any additional charges / out of pocket expenses whatsoever e.g. car parking, toll road charges etc are in addition to the stated package prices. Please ensure one car park space is available at all venues we are attending. We cover the whole uk, depending on the distance from our office a fee will be charged.  If you are unsure of distance, please confirm before booking.  We charge a fee based on travel time and distance not just a pence per mile.

Normal post production time is 8 to 12 weeks from your wedding Date out of wedding season and 14-20 weeks during July-December.  We aim to submit work as it becomes complete online i.e we hope to share with you the ceremony and speeches before completing our main videos.  This is an estimate and may change. We will only send one reminder after the wedding if you haven't submitted your choices.  We do not provide our own choices unless the music is not provided within 60 days from your booked wedding date.  If not provided our decision on music is final.

Dave Spink Photography may at our discretion use any footage, names, dates etc taken from your wedding film for promotional activities. This may include, (but not be limited to), inclusion on our website, promotional materials etc. If you wish not to be included in this then please contact us in writing.  If you do not want to have your footage / photos used in the way we ask that you pay a fee of £50 as this is how we manage to keep our prices lower than our competitors.  We do not attend wedding fairs  

Any queries must be received in writing within 48 hours of delivery of finished product. DSP cannot be held responsible for removal and disposal of raw footage after this time. We do not offer RAW footage as part of the agreement.  This remains the property of Dave Spink Photography.  It cannot be purchased or given away

The music to accompany your production is your choice and therefore is up to you to seek copyright approval for use within your video to the PRS. We cannot be held responsible for any claims arising from breach of copyright. We can arrange the purchase of copyright licenses, the cost of any license is in addition to any fee paid to Dave Spink Photography. All music must be provided by you unless by prior arrangement. If no music is provide we reserve the right to obtain and use music at our artistic leisure.   Any Additional content that you would like to be used in the video MUST be pre-agreed and submitted to This email address is being protected from spambots. You need JavaScript enabled to view it. no later than 30 days from the date of the wedding.

Any technical errors will be corrected free of charge, these must be reported within 48 hours as we don't have the capacity to store raw footage for longer.  Client requested changes to their video will be charged at the hourly edit rate, this is £150.   

 

Photo Booth Hire Terms and Conditions

Dave Spink Photography - Booth Booth & Mirror Hire Terms & Conditions of Hire

 This agreement contains the entire understanding between Dave Spink Photography herby known as (DSP) and the client. It replaces any prior agreements that may have been made.  A signed contract and deposit are not necessary to confirm the stated  services from DSP for Hire

1.  DEFINITIONS AND INTERPRETATION

 

1.1 In this Agreement unless the context requires otherwise the following words and expressions have the following meanings:

 

'Contact’ means the contact named by the Hirer on the Booking form. Please note that if on the day the Contact is not available then Dave Spink Photography reserves the right to select an appropriate alternative. This may include, but not be limited to, a member of staff at the Venue, an events coordinator, a User or a close family member or friend of the Hirer or indeed the Hirer themselves.

 

Booking form' means the form completed to confirm details of booking including Contact on the day. This may also be in the form of an e-mail.

 

'Hirer' means the Main booking contact named on the Initial Booking Form.

 

'Hire date' means the date the Hired equipment  is hired.

 

'Hired equipment ' means the "Dave Spink Photography” system and related equipment.

 

'Location' means the Location of the Hired equipment  once delivered and setup by a Dave Spink Photography Representative on the Hire date.  Delivery charges apply for ALL hires over 20 miles from our office.  This fee is in addition to our package price and is dependent on distance and travel time.  Please ensure you are clear on the final cost before making your booking.

 

'User' means the people that use the Hired equipment  whilst out on hire to the Hirer.

 

'Venue' means the postal address at which the Hired equipment  is to be located on the Hire date.

 

'Dave Spink Photography Representative' means a representative, either employed directly or sub-contracted for  Dave Spink Photography .

 

1.2 In this Agreement the words 'include', 'includes', 'including' and 'such as' are to be construed as if they were immediately followed by the words 'without limitation'.

 

1.3 Reference to the singular includes the plural and vice versa.

 

2.  COMMENCEMENT 

 

2.1 The Agreement shall commence on the date the Booking Form is completed or confirmation of booking is received via e-mail and shall remain in place until the Hired equipment  is either collected or returned to the satisfaction of Dave Spink Photography.

 

 

3.  USE OF THE HIRED EQUIPMENT  

 

3.1 The Hirer is to ensure the Hired equipment  is used properly and ensure that it will be used safely and without risk to health, shall not remove or alter or permit removal or alteration of identification numbers or marks of the Hired equipment , and shall keep the Hired equipment  properly protected and safe. Under no circumstances shall Dave Spink Photography have any liability of whatever kind for any defects resulting from wear and tear, accident, improper use by the Hirer or Users except in accordance with the instructions or advice from Dave Spink Photography.

 

3.2 The Hirer is to ensure the Hired equipment  shall not be moved from both the Location and Venue other than by a Dave Spink Photography Representative.

 

3.3 The Hirer is to obtain any consent or permissions in the use of the Hired equipment  at the Venue and Dave Spink Photography shall not be held liable for refusal or lack of any consent or permission.

 

3.4 The Hired equipment  shall at all times remain the property of Dave Spink Photography.

 

3.5 The Hired equipment  shall be delivered on date of Hire at which time Dave Spink Photography Representative will leave the Hired equipment  operational and in suitable condition for use. The Contact on the day, or, agreed alternative Contact will receive the Hired equipment  demonstration to confirm they agree the Hired equipment  is operational and not damaged.  Use of the booth after this point will form agreement that the booth is fully operation.  In the event the booth is required to be left IDLE and the equpimnet hasn't been demonstrated this is at the hirers risk.  Any damage once the booth is setup and ready is at the hirers liability. We can not hire after midnight all hire must be concluded by this time

 

3.6 Dave Spink Photography Representative has the right to refuse to deliver the Hired equipment  if:

 

It believes that the Hired equipment  will not be used properly;

The Venue or Location is believed to be unsafe or a risk to health;

The Venue or Location is believed to possibly cause damage to the Hired equipment ;

The Venue or Location is believed to not be secure;

The Contact on the day cannot be found

No onsite parking provided / parking payment not covered

If The Contact on the day refuses to accept delivery of the booth

The Balance hasn't been settled in full 1 month prior to hire

 

No refund of payment will be made if any of the above applies.

  3.7 The Contact on the day has the right to refuse to accept the delivery of the Hired equipment  if:

 

The Hired equipment  is damaged to the point of being unusable;

 

 3.8 Dave Spink Photography reserve the right to deliver an alternate model or graphically designed hired equipment , at it’s own expense in the event the model selected at the time of booking is not available for hire, in the event we're unable to provide a replacement this agreement will cease and a full refund will be issued.

 

4.  PAYMENT

 

4.1.  A booking fee as specified upon the Booking form shall be paid by the Hirer to Dave Spink Photography. A receipt in the form of an e-mail shall be sent to the Hirer. The receipt is the only proof of booking that the Hirer shall receive.. We cannot reproduce order confirmations unfortunately. Please ensure you enter the balance on your booking request is the amount quoted including travel.. We cannot take responsibility if you entered the wrong amount.

 

4.2.   If the Hirer fails to pay the invoice price by the date due then Dave Spink Photography has the right to cancel the booking with no money previously paid being returned to the Hirer. The full amount will be due at this time with an discounts voided and all costs to be paid.  This includes legal costs if the debt is recovered via the courts.

 

4.3.  No refunds are to be given due to fault of the Hirer in operation of, or use of, the Hired equipment , or in lack of obtaining, or in the refusal of the appropriate consents or permissions. No refund will be made for low usage of the facility.  No refund will be supplied if the wrong details are provided which delays the team in arriving and setting up on time.

 

4.4.  The Hirer is responsible for ensuring that a minimum 3m by 3m space is left vacant for setup of the hired equipment .  This must be within 2m of a 13amp single working socket.

 

4.5 The Hirer is responsible for ensuring any documents required such as PAT or PLI are requested no later than 3 months before hire.  We are unable to produce on the day or sign venue waivers.

 

 5.  CANCELLATION

 

5.1  Upon receipt of written notification of cancellation prior to Hire date Dave Spink Photography shall not refund any monies paid, in the event Dave Spink Photography cancels the event the agreement will end and a refund of all money paid will be returned except when 4.3 applies. A change of date is classed as a cancellation of the original booking.  A new booking will need to be made via our website to confirm any new date.

 

 

 

5.2  Upon receipt of written notification the following cancellation fees will apply

All cancellations will have offers and discounts voided and will be charged at the current or higher rate.

 

Dave Spink Photography reserves the right to charge a late payment fee of £50 per month.

 

6.  DAMAGE LOSS AND REPAIR

 

6.1 The Hirer shall be responsible for the loss, theft or destruction of or for any damage to the Hired equipment  occasioned in any manner or by whosoever or by any cause whatsoever while the Hired equipment  is at the Hirer's risk (other than as a result of fair wear and tear) and fully and effectually indemnify  Dave Spink Photography in respect of all claims, proceedings, costs, expenses, loss, damage and liabilities incurred by Dave Spink Photography arising directly or indirectly form any such loss, theft, destruction or damage.

 

6.2  Dave Spink Photography  shall not be responsible for any losses or equipment failure which is beyond its control.

 

 6.3 Any Travel fee paid will not be refunded in the event of system failure

 

7.  TERMINATION ON DEFAULT, ETC

 

7.1. Without prejudice to the provision of clause 4.4 Dave Spink Photography may by written notice (in addition to any other rights) terminate this Agreement or suspend its performance of all or any of its obligations under the same immediately and whether for compensation or damages or otherwise if the Hirer fails to comply with any of its obligations under the terms of this Agreement.

 

8.   ENTIRE AGREEMENT

 

8.1. This Agreement expresses the entire agreement between of the Parties in respect of the matters contained or referred to in it and there are no promises, terms, conditions or obligations oral or written express or implied other than those contained herein.

 

8.2.  No warranties, representations or other matters were relied upon by the Hirer causing it to enter into this Agreement other than those expressly set out herein.

 

 8.3.   Except in the case of fraudulent misrepresentation the only remedy available to the Hirer in respect of any misrepresentation or untrue statement made to it shall be a claim for breach of contract.

9.    FORCE MAJEURE

 

9.1.  Dave Spink Photography shall not be liable for any failure in the performance of any of its obligations under this Agreement caused by, and may suspend performance of the same during, factors outside its control including, but not limited to, disorder and natural disasters.

 

10  THIRD PARTIES

 

10.1. The Parties do not intend that any term of this Agreement may be enforced by a third party as defined in the Contracts (Rights of Third Parties) Act 1999 under the provisions of that Act.

 

11. NOTICES

 

11.1.  Any notice required to be given for the purposes of this Agreement must be given by registered or recorded delivery mail.

 

11.2.  The Hirer's address for the service of notice shall be the address stated on the Booking Form. Any changes of address must be notified and acknowledged to be deemed as valid.

 

11.3.   A notice shall be deemed to have been serviced if a notification of completed recorded delivery notice is provided via royal mail.  

 

11.4 The Hirer acknowledges and accepts all materials (video, photo and text messages) recorded on the day can be used by Dave Spink Photography for the purpose of promoting and advertising its products and services. Furthermore the Hirer does not hold Dave Spink Photography liable for any issues arising through the use of such material.  If you would rather the images were not used for marketing please speak to the team and make a payment of £50 to be exlcuded.  

 

11.5 All images are stored on our cloud service for 1 month.  If not downloaded before this point we are unable to retrieve old event images

 

12. CHOICE OF LAW AND JURISDICTION

 

12.1.This contract shall be governed by English law and subject to the exclusive jurisdiction of courts of England and Wales in all matters regarding it except to the extent that Dave Spink Photography invokes the jurisdiction of the courts of any other country.

 

These Terms of Use affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Use, do not access or use the Service.
